Assignment of the contract

Reservations

General booking conditions

You can make a provisional reservation by phone, but all reservations must be made through our online system or through a complete form sent by email.

You will receive an order confirmation by email. The content of these booking confirmations is archived by Perma Social Club.

The reservation becomes firm when a deposit of the total price has been paid. By this method we make sure that you understand and accept these conditions.

For providers: providers can book for their participants using a booking form sent by email or online booking form. The service providers are required to make their participants aware of these General Conditions of Sale before reserving and managing all communications with their participants. The service providers assume all responsibility for transferring all travel-related information and any communication concerning the stay to their participants. For legal reasons, however, providers ensure that payments are made through the Perma Social Club. This process is applicable if the reservation is made at the last minute.

Last minute reservations

If you book a service within 14 days of departure, you must submit a booking form online or by email.

The balance is due within 24 hours of confirmation on the Perma Social Club website, by bank transfer or on the Lydia app.

Down payments

These are applicable as soon as one night is included in the stay. Unless the reservation is made last minute, and in order to guarantee your reservation and confirm availability, a deposit of 30% of the value of the stay is applied at the time of booking. The balance is due 30 days prior to departure.

At the time of booking, you must pay your deposit on the Perma Social Club website, by bank transfer or on the Lydia app to guarantee your reservation.

The deposit of 30% of the amount of the stay will be deducted from the final amount due, which will be requested on the day of the final payment, in the event that services are added or modified by one of the parties to the contract.

If the reservation is made within 30 days of departure, the full amount of the stay will be charged. The price of the trip is per participant and includes the elements mentioned in the description of the trip. As part of an overnight stay, any request for a single (individual) room is subject to additional charges and must be made at the time of booking.

Deposits are not applicable if you decide to pay the entire stay at the time of booking.

Your reservation can only be confirmed once the deposit or payment has been received into the Perma Social Club bank account.

Payment

The balance of the payment is due at least 30 days before the departure of the stay. The balance can be paid by credit card, transfer or on the Lydia application. We will contact you before the final payment date to give you the option to pay using one of these methods.

If we do not receive the balance of payment or if we have no communication regarding your payment intentions 30 days before the departure of the stay, your reservation will be canceled and you will be subject to the cancellation conditions below.

If your currency is not the Euro, you will be responsible for transfer fees and other bank charges.

Cancellations and modifications

Cancellation

Cancellation of the stay by the participant

Any cancellation must be notified by email to Perma Social Club.

For any cancellation by the Participant, the amount retained by Perma Social Club will be as follows:

a) From the signing of the contract to 30 days of departure: 30%

b) From 29 days to 21 days before departure: 50%

c) From 20 days to 8 days before departure: 75%

d) Less than 8 days before departure: 100%

e) No-show at the start, a "no show": 100% of the total price

Any cancellation less than 30 days before the date of travel incur the above cancellation costs, unless you are replaced by another person ready to travel in your place and under the same conditions. No refund will be made once the trip has started. No exceptions to this cancellation policy, including for reasons related to weather conditions, terrorism, civil war, personal, family or medical emergency or other circumstances beyond our control. For this reason, we strongly encourage participants to purchase Trip Cancellation Insurance and Interruption Insurance.

Cancellation of stay by Perma Social Club

When Perma Social Club is obliged to cancel before the start of the stay, the participant will be reimbursed immediately and without penalty of the sums paid. Perma Social Club takes particular care in the choice of its service providers and thus ensures compliance with the contractual commitments made to participants when ordering any service whatsoever. With regard to tourist package services, Perma Social Club cannot be held liable for any non-performance or improper performance of all or part of the services provided for in the contract which would be attributable to the participant, to exceptional and unavoidable circumstances or to the unforeseeable and insurmountable fact (meteorology), of a third party foreign to the provision of the services provided for in the contract. With regard to all other services, Perma Social Club can only be held liable in the event of damage caused by a fault on its part demonstrated by the participant.

Modification

Modification of the stay by the participant

If you wish to make a change to your stay or itinerary, you must submit your request to us by email. Once a reservation request is received and confirmed, an associated fee will apply for any modification of dates or itineraries. Fees vary depending on the type of change and the scope of the change. Our suppliers, especially web hosts, often impose additional fees or penalties for changes and cancellations.

These are included in the modification fee and can be substantial. Modification fees, minimum € 59 per person, apply to any modification taking place 30 days before the start of the stay.

Modification of stay by Perma Social Club

When, during the stay, Perma Social Club is unable to provide part of the services provided for in the contract, Perma Social Club undertakes to find a similar alternative. If this represents a significant percentage of the price, Perma Social Club will offer a replacement activity, possibly supporting any additional price. If the similar alternative that you accept is of inferior quality, Perma Social Club will offer you either a partial reimbursement of the service or an additional service during the stay. If Perma Social Club cannot offer you a similar replacement service, Perma Social Club will offer you a different service, or will offer you a refund for the service not provided.

Description

The descriptions of the stays are established when the brochures or the descriptions of the stays go to press; any modification resulting from technical impossibilities will be indicated to you and similar services will be offered to you. No compensation may be demanded for the non-enjoyment of a service not provided following a case of exceptional and unavoidable circumstances.

Certain services require a determined number of participants: if this number is insufficient, we may be obliged to offer you a replacement service with other travelers, without you being able to claim compensation.

Responsibility

We act as an agent or intermediary for the various independent suppliers who offer accommodation, meals, transportation, tourism, activities or other goods and services related to your stay or visit.

Consequently, the retailer and the organizer are responsible for the proper performance of the services provided for in this contract and are required to provide assistance to the traveler in difficulty. In the event of their full liability arising from service providers, the compensation limits resulting from international agreements in accordance with article L. 211-17-IV of the Tourism Code will apply; failing this and except for bodily injury, intentional or negligent damage, any damages are limited to three times the total price of the trip or stay

No refund will however be given in the event of delay, cancellation, overbooking, strike or exceptional and unavoidable circumstances of a supplier, or for the elements of the stay that you do not use.

All prices, schedules, routes mentioned in our programs may be changed as a result of circumstances beyond our control, or which would be taken by the local service providers to whom we turn.

Perma Social Club reserves the right to eventually replace one service provider with another, a transporter or a hotel with an establishment of the same category.

Travel insurance

Although Perma Social Club has professional civil insurance, the price of the stay does not include travel insurance. We strongly recommend that all participants take out comprehensive travel insurance, covering trip interruption, baggage and accident / life and other expenses that may arise as a result of loss, damage, injury, delay or inconvenience occurring to participants.

We assume that you will have purchased from another insurance company of your choice.

We remind you that you are responsible for all damage caused by you. You are required to be insured by a civil liability insurance contract for these various risks.

Price

In accordance with articles L.211-12, R. 211-8 and R. 211-9 of the Tourism Code, the prices provided for in the contract may be revised upwards or downwards to take into account variations in the cost of transport (fuel / energy), charges and taxes and exchange rates. You will be informed of any increase in the total price of the package no later than 20 days before departure. The prices indicated have been established on the basis of the economic conditions existing at the time of the creation of this contract, and any modification of the prices of our service providers and of the monetary parities may result in their modification. If the increase exceeds 8% of the initial total price, the participant has the possibility of canceling his trip, without any charge.

Our prices are denominated in Euro and do not include: drinks unless explicitly mentioned, tips, exceptional expenses resulting from unforeseen events (strike, weather conditions etc.) nor travel, cancellation and luggage insurance.

Our prices may vary according to the period during which the trip is made and sometimes according to the number of participants.

The prices are indicated in the descriptions throughout the reservation and / or payment process. When payment is possible online, the price is immediate and firm.

Withdrawal period

Pursuant to the provisions of Article L 221-28 of the Consumer Code, the services offered on the site by Perma Social Club are not subject to the application of the right of withdrawal provided for in Articles L 221-18 and following of the Code of distance selling consumption. Consequently, the services ordered on the site are exclusively subject to the cancellation and modification conditions provided for in these general conditions of sale and you will not be able to invoke the right of withdrawal.

Territoriality of applicable legislation and jurisdictional competences

The parties agree that this contract is governed by French law including with regard to the definition of jurisdictional competences. If you do not do this while you are on the stay, your ability to claim compensation from Perma Social Club will be reduced or impossible. Additionally, if you make changes to the itinerary without providing the notice described above, you assume responsibility for any added charges you may incur as well as forfeiture of any potential refunds.

If you are not satisfied with this notice procedure during travel, you must submit a written complaint to Perma Social Club within 2 years of the end of your stay. Perma Social Club will not accept any responsibility for complaints received after this period.

Travel documentation

Documentation before the stay

After receipt of your final payment, you will receive several documents by e-mail: confirmations and travel information, an overview of what to expect during your stay and a liability waiver. Suggestions and recommendations for your equipment, clothing, preparations, etc. will also be included.

Please read these documents carefully as soon as you receive them and contact us if any information appears to be incorrect.

We cannot accept any responsibility if we are not informed of any inaccuracies in a document, which must be mentioned by you to Perma Social Club, its owners, employees, agents or representatives, within 10 days. .

Documentation during the stay

You are responsible for ensuring that all necessary travel documents are valid and in your possession for the duration of the stay.

Some foreign nationals will be required to have a Visa to enter Europe. Where applicable, passports are required and must be valid for at least 6 months after your return date. You are responsible for the passport obligation, and we suggest that you plan your passport application or renewal as soon as possible. Please check your government requirements.

You assume full responsibility for the control and verification of all passport and visa requirements. You are also only responsible for the adverse consequences resulting from missing or defective documentation.

While we may provide good faith and courtesy information or advice on climate, clothing, luggage, special equipment, etc., we are not responsible for any errors or omissions in the information provided.

Tours and excluded items

We invite you to check the description of each trip to see what each trip includes. The services vary depending on the stay. Our stays and tours do not include travel costs such as train tickets, airport transfer, travel and / or medical insurance, excess baggage charges, or any personal items. Meals other than those mentioned in the stays are not included, as well as any unpaid visits or optional products or tourist activities. Health requirements

Our tours can generally be physically active and requirements vary depending on the specific itinerary. As such, good physical and mental health is essential for the enjoyment and safety of our stays.

For example, our farm tours require moderate activity while some of our cycling trips can be very difficult. We encourage you to carefully read the descriptions of the physical requirements necessary for a stay before registering, and to contact us for details if you have questions about your ability to participate.

If, during your stay, you are not able to continue the activity, we reserve the right to offer you a lighter alternative instead, insofar as this is logistically feasible. However, we cannot guarantee that an alternative is possible, particularly when it comes to continuing an activity with other participants or with providers specific to the original activity.

If you judge that you are not able to continue an activity during the stay, you can abandon this part of the stay to ensure your safety as well as the safety of the other people concerned. If we or our appointed service providers deem that you are not fit to continue any activity, and that we cannot reasonably offer you an alternative activity, we reserve the right to oblige you to give up this activity. No reimbursement, even partial, will be granted for activities that you must thus abandon.

By signing these general conditions of sale, you certify that you have no medical or other contraindication that could create a danger for you or other participants or affect the enjoyment of other people of the stay.

Accommodation, meals and transportation

Accommodation

Accommodation is not automatically included in the services offered by Perma Social Club, it can be included on request and added to a daily activity.

For a package holiday, accommodation can be included from the start to the end of a stay. Prices are based on double occupancy rooms which include a bath or shower. Single rooms (single) are limited and require an additional charge.

For group package stays, single people who do not request single rooms will be booked in a double room with another traveler of the same sex when possible. If a sharing arrangement is not possible, the supplement will be assessed prior to departure, when we have confirmation that there will be no additional travelers.

If other accommodation of the same category is booked due to lack of availability, there will be no change in the price of the trip. If availability makes it necessary to book lower / higher category accommodation, you will be notified in advance and we will give you the option of accepting or rejecting the change as well as any change in the price of the trip. We are not responsible for the quality or location of alternative accommodation.

Meal

Transport

Bicycles

For cycling trips, we recommend that you bring your own bike for more comfort. Participants who wish to bring their own bikes are responsible for maintenance and all mechanical issues. In addition, these participants are also responsible for the logistics of moving their bikes to the point of departure of the stay as well as from the place of end of the stay, in particular with regard to the transport by train or plane of the bike.

Except Le Grand Tour Cycliste, bicycle rentals are optional for stays and may be available at an additional cost. We do not manage reservations and bicycle rentals and can however recommend a specialized agency. You also agree that you will be subject to all the terms and conditions of the company from which the reservation and rental of the bike was made.

The bikes would likely be good quality mountain bikes (mountain bikes) or mountain bikes (VTC), or even electric bikes, depending on the availability of our suppliers. If you are planning to rent a bike, you will be responsible for it once you take possession of it. You will be held responsible for any damage or theft. In some cases, a supplement will have to be paid in case of delay for the return of the bike, or change of bike during the trip. Emergency service

For each stay, we will give you an emergency telephone number or the details of a contact point to reach Perma Social Club or our partners.

For a cyclo-tourist stay supported by a guide in a van, your guide can be made available by phone. The following are examples of the reasons for emergency calls: equipment failure; minor injury / illness that prevents continued cycling or walking, (serious injuries must first be reported to your attendant and the appropriate authorities), missed trains, or the need to schedule additional services such as transfers . This service is only available during the day.

Although your attendant may make himself / herself available, depending on the distances involved or other competing obligations of the attendant, an immediate response time is not guaranteed. For any other stay, your guide, escort, counselor or hotel staff will be available for other questions not related to emergencies outside your activities. However, we advise you to contact the competent authorities in an emergency requiring medical assistance.

Plane, car and train

Airline, car and train reservations

We do not manage airline and train ticket reservations, as well as car reservations and rentals. However, we can recommend a general travel agency for such requests. You also agree that you are subject to all the terms and conditions of the company with which the reservation of airline tickets, train or car rental was made. You are responsible for familiarizing yourself with these terms and agree that you are responsible to these suppliers for reservations, changes, cancellations and various problems or the like, for the reservation having been made on your behalf.

For a train journey with a bicycle, we advise you to familiarize yourself with the rules for transport by TGV and other trains. Before traveling by train, please make sure you are aware of the baggage limits.

Modifications

You understand that amenities, accommodations, types of transportation, routes, schedules and itineraries of stays may change without notice due to local circumstances or events, which may include mechanical failure, illness, strikes, political conflicts, weather and other unpredictable factors.

On guided tours, the decision of the local guide or local provider is final on all matters that may threaten safety or interfere with the well-being of the group or individual participants. During the stay, we have the right to expel a person (s) whom we:

a) deem ourselves incapable of meeting the rigors and demands of participation in tourist activities; or

b) prejudice the enjoyment of the stay of other participants.
